Abstract

This article discusses the Alabama Wrongful Death Act and examines the explanations the Alabama Supreme Court has offered for its unique interpretation. The Alabama Wrongful Death Act is the only one in the nation which allows the recovery of only punitive damages. This article explores the different criticisms of this unique Act, and offers a proposal for change.
